Terms of service
Welcome to PrimeTrack Telematics Limited. These Terms of Service govern your use of our GPS tracking and telematics services. By accessing or using our services, you agree to comply with and be bound by these terms. Please read them carefully.
Service description
PrimeTrack Rwanda provides GPS tracking and telematics services that enable users to track and monitor vehicles, assets or individuals through our platform and associated software.
User obligations
By using our services, you represent and warrant that you are legally capable and have the authority to enter into this agreement. You agree to use the services in compliance with applicable laws and regulations in Rwanda, and you will not use the services for any illegal, unauthorised or fraudulent purposes.
User account
To access and use our services, we provide you with appropriate user accounts carrying rights commensurate with your purchase plan. You are responsible for maintaining the confidentiality of your account information, and you accept responsibility for all activities that occur under your account.
Data privacy and security
At PrimeTrack Rwanda we prioritise the privacy and security of your data. Our Privacy Policy explains how we collect, use and protect your personal information. By using our services, you consent to the collection, use and disclosure of your information as described in that policy.
Intellectual property
Our services and all related software, technology and content are protected by intellectual property laws. You agree not to copy, modify, distribute or create derivative works based on our services without our prior written consent.
Termination
We may suspend or terminate your access to our services at any time and for any reason, including if you violate these terms. You may also terminate your account by providing written notice to us.
Governing law and jurisdiction
These terms are governed by the laws of Rwanda. Any disputes arising out of or relating to them are subject to the exclusive jurisdiction of the courts in Rwanda.
Limitations of liability
Our services are provided on an "as is" and "as available" basis. While we work to ensure accuracy and reliability, we do not guarantee uninterrupted availability of the third-party services our services rely on, such as GSM network availability and GPS satellites. To that extent, you accept that we are not liable for any direct, indirect, incidental, consequential or punitive damages arising out of or in connection with the use of our services where such third-party services fail or are affected by outside factors, or where acts of sabotage affect our service.
Caveat emptor
Tracking devices are valuable aids in monitoring assets, ensuring vehicle safety and gathering telematics data. Their functionality depends on a number of external factors beyond the control of the tracker hardware: the availability and reliability of GSM network signals, the availability of GPS satellites in the area, variations in terrain and topography, and weather conditions from time to time. Users are advised not to rely solely on trackers in emergency situations or for critical data assessments. While trackers play a major role in enhancing security and telematics data collection, users should consider keeping alternative emergency measures in place alongside their tracking devices. This caveat is an industry-wide acknowledgment of the dependencies inherent in tracking technology worldwide.
Entire agreement
These terms constitute the entire agreement between you and PrimeTrack Rwanda regarding the use of our services, and supersede any prior agreements or understandings.
